General terms and conditions for rental of sloops

ARTICLE 1. DEFINITIONS

  • Landlord; Joppe Watersport VOF.
  • Tenant; the person with whom the landlord has entered into the lease, with a minimum age of 21 years.
  • Rental agreement; agreement between lessor and lessee for the rental of a vessel.
  • Insurance; third-party and hull insurance purchased through Meijers Assurantien in Amsterdam. Conditions and related clauses are available for inspection at Landlord’s office.
  • Area of insurance; the vessel may be used in the following areas: Kagerplassen, Joppe Not to be sailed. (i) on waters marked as prohibited to mechanically propelled boats on the water chart or by means of traffic signs and (ii) the inland waters of the municipality of Leiden excluding E-sloops.
  • Deposit; Fixed amount per occurrence to be paid by lessee to lessor upon acquisition of boat.

ARTICLE 2. OBLIGATIONS OF THE LANDLORD

  • At the start of the rental period, the lessor transfers the boat to the lessee. The lessor shall ensure that the boat is in good condition, and can serve the use for which it is intended, equipped with proper safety equipment for the agreed sailing area.
  • The lessor is obliged to insure the vessel for the benefit of the lessee against third-party liability, hull damage and theft for sailing in the sailing area agreed upon between the lessor and lessee.
  • The cost of normal maintenance and repair of defects shall be borne by the landlord.
  • The lessor shall ensure that the lessee receives a refueled boat.
  • The landlord must return the deposit (or a proportional part due to costs or damages that still need to be settled) to the tenant after the rental period.
  • The lessor will arrange for the purchase of a general boating license valid for the waters in the area of the Rhineland Water Board. The sticker accompanying the permit is affixed to the sloop in a clearly visible place.

ARTICLE 3. OBLIGATIONS OF THE TENANT

  • Before sailing, the parties must sign the agreement for agreement. The tenant will receive a copy of the agreement.
  • Renter is required to present valid identification to the rental company when picking up the sloop. The landlord will take a picture of this and will add it to his section of the lease.
  • Tenant must personally use the leased property – during the term of the agreement – in accordance with the purpose specified in the lease. The lessee may not rent out or lease the sloop without written permission – in advance – from the lessor.
  • The deposit must always be paid to landlord in advance, as well as other rental fees.
  • During the rental period, the renter is responsible for the proper use of the boat and for regularly checking and, if necessary, securing the boat, engine and inventory. At the end of the rental period, the lessee shall hand over the boat to the lessor at the agreed time and place and in the same condition in which he received it.
  • Costs directly related to the use of the sloop, such as harbor, bridge, wharf, lock and mooring fees, fines, etc. are the responsibility of the renter.
  • Renter is obliged to return the boat clean. Failure to comply with this obligation will result in a cleaning charge, with a minimum of U 25.00 (incl. VAT).
  • The tenant needs the landlord’s permission to have repairs done. The landlord will reimburse the tenant for the cost of repairs if itemized bills in this regard are presented.
  • The Lessee must report damage of any kind, or facts and/or circumstances that could reasonably lead to damage, to the Lessor as soon as possible. The lessee must comply with the lessor’s instructions to preserve the boat and maintain the lessor’s rights. Failure to comply with this provision may result in full liability for damages and costs for the tenant.
  • Renter shall, if necessary, fuel suitable for the boat. Damage caused by administration of wrong fuel will be borne by lessee.
  • The renter is not allowed to use the sloop for races based on speed and/or agility.
  • Tenant is required to comply with the regulations of the High Water Board.
    council of Rhineland. The penalty resulting from failure to comply with these regulations is the sole responsibility of the tenant.
  • By signing the rental agreement, the tenant agrees that a copy of his/her ID will be made, which will be kept by the landlord (during the rental period). When making the copy, the passport photo and BSN need not be shielded.

ARTICLE 4. LIABILITY

  • Renter is obliged to take appropriate measures to prevent and limit damage to the boat and any related rented accessories.
  • The renter is liable for damage to and/or loss of the boat
    and any related rented accessories, insofar as not covered by insurance, arise during the time he has the vessel in his possession, unless the hirer proves that he is not at fault in this respect or that he cannot be blamed for any negligence. Damages also include consequential damages.
  • The renter is fully liable for the (consequential) damages caused by him which are not insured under the insurance mentioned in article 1.4 in case he uses the boat in the uninsured sailing area mentioned in article 1.5.
  • Renter is fully liable for all damage to a third party or damage to or loss of the vessel caused by or resulting from; Sailing under the influence, as stipulated in the Shipping Traffic Act; participation in races/speed contests or what can be equated to such.
  • Landlord is not liable for damage to contents other than those of the boat owner.
  • Landlord is not liable for death, personal injury or damage to the property of Tenant and other persons on board unless there is gross negligence by Landlord.
  • The excess for damage to the boat per occurrence is equal to the amount of the deposit. In case of culpable damage, this will result in the retention of the deposit. Thus, in the case of multiple events, lessee may be held liable for the deductible per event. If the damage is recoverable from the other party, the claim form – completed and signed by both parties – will be processed by Meijers Assurantien. If the damage is recovered from the other party, the lessor will refund the excess or deposit already paid to the lessee.

ARTICLE 5. WANPRESTATION

  • Landlord may unilaterally terminate the rental agreement at any time during the rental period, without being required to refund all or part of the rent if: a. weather conditions require it (in wind force 6 or higher, no sailing is allowed); b. tenant fails to comply with the rental terms; c. tenant causes nuisance in or around the Hollandse Plassen or Leiden waters and hunting and passing ports. All at the discretion of the landlord.
  • If the boat is handed over at the agreed place later than the agreed time, the lessor is entitled to an increase in the rental fee of € 15.00 per quarter hour, and to compensation for further (consequential) damage, unless the lessee can prove that the late return cannot be attributed to the lessee.
  • If the boat is not handed over by the hirer in the same condition in which he received it, or if he has not acted in accordance with Article 4 of these conditions, the lessor is entitled to restore the boat to the condition in which it was at the start of the hire period, at the expense of the hirer. The latter does not apply when said costs are covered by insurance.
  • It is not permitted to take a seat in the boat with more than the number of people specified by Joppe Watersport, or to use the boats other than as intended by the lessor. If it is found by lessor that more than the maximum number of persons indicated on board are sailing, the full deposit will be retained.
  • The captain of the boat must be sober at the time of operating the boat, and not exceed the legal blood alcohol level. If the renter finds that this is not the case, he will immediately proceed to retrieve the boat without any refund of rent and deposit.

ARTICLE 6. CANCELLATION

  • In case of bad weather, the reservation can be rescheduled to an alternative date up to 60 minutes before the start of the rental period without charge. Tenant determines what they mean by inclement weather. This article does not apply to early cancellation of the rental period due to bad weather, this risk is the responsibility of the renter and does not constitute grounds for reduction or refund of the rental fee, or cancellation of the rental agreement.

Subscription conditions GOLD & PLATINUM

ARTICLE 1. SUBSCRIPTION

  • Host: Joppe watersport
  • Subscriber/Tenant: Member
  • Sailing season: 01-05-2022 to 01-10-2022
  • GOLD: unlimited rental of one lounge boat, or one E-sloop, or one Sup during weekdays (Monday through Friday) excluding recognized holidays
  • PLATINUM: unlimited rental of one lounge boat, or one E-sloop, or one Sup during all days of the week including recognized holidays
  • Times: from 9:30 a.m. until sunset and insofar as it occurs after 8:30 p.m.; until no later than 8:30 p.m.
  • Subscription is for Lounge Boat, E-Sloop & Sup
  • Subscription is personalized. Member provides a copy of ID proof at start of subscription. Member must provide identification each rental period.
  • If Member fails to pick up the boat, sloop or Sup more than 2 times at the reserved time, Joppe Watersport has the right to terminate the subscription for the rest of season. There will be no refund of the subscription fee or any part thereof.
  • In case of non-compliance, Joppe Watersport is authorized, without further obligations, to terminate the subscription.

ARTICLE 2. COST

  • Platinum subscription: €2,195.
  • Gold subscription: €1,645.
  • Fuel ships: included
  • Port and bridge fees: for member

ARTICLE 3. THE BOATS

  • Lounge boats for up to 10 adults with gasoline engine
  • E-Sloop for up to 8 adults with Electric Drive
  • Boats must be returned clean and tidy.
  • Boats are equipped with cushion and fenders
  • Lounge boats not allowed to pass through Leiden
  • E-Sloops may sail through Leiden but at Member’s own risk
  • Driver of the boat must not consume alcohol or narcotics.
  • Damage to the boats must be reported immediately to the Lessor.
  • In case of engine failure, member will initially attempt to return via “tow” to the rental location at Veerpolder 3 in Warmond. Should this fail, if a boat is available, Landlord will come and exchange and/or repatriate boat.

ARTICLE 4. RESERVE

  • After receiving the subscription fees, making a reservation is possible.
  • Member receives unique code to book boats Online.
  • Reservations are only possible if there is availability.
  • Within 24 hours before start of rental period, online booking can be made and reservation is guaranteed.
  • 1x per week a guaranteed reservation can be made up to 24 hours before start of rental period. Landlord is authorized to shift reservations if multiple bookings are made up to 24 hours in advance) per week. Landlord will notify Member accordingly.

ARTICLE 5. LIABILITY

  • Lessor assumes no liability for loss or damage to goods/personal property on board and/or on Lessor’s premises.
  • Parking of bicycles and vehicles on Landlord’s premises is at your own risk
  • Member is advised to purchase continuous travel insurance from her own insurer
  • Lessor assumes no liability for bodily injury sustained aboard or on Lessor’s premises.
  • Member is responsible for all accessories in and on the boat. If cushions, anchor, fenders, ropes or other accessories of the boat are lost, they will be charged separately.
